The Five Step Sequential Evaluation Process

 To be eligible for  disability benefits, a claimant must demonstrate a medically determinable impairment which prevent the claimant from engaging in substantial gainful activity and which is expected to result in death or to last for a continuous period of al least 12 months.

Disability claims are evaluated using a five-step test;

1- Is the claimant engaging in substantial gainful activity? If so, the claimant is found not disable. If not, proceed to step two.

2- Does the claimant have a "severe" impairment? If so, proceed to step three. If not, then a finding of not disabled is appropriate.

3- Does the claimant is impairment or combination of impairments meet or equal an impairment listed in 20 C.F.R. Part 404, Subpart P. Appendix 1?  If so. the claimant is automatically determined to be disabled. If not, proceed to step five.

4- Is the claimant capable of performing his past work? if so, the claimant is not disabled. If not, proceed to step five.

5- Does the claimant have the residual functional capacity to perform any other work? if so. the claimant is not disabled. If not, the claimant is disabled.

Para decidir si usted esta incapacitado, los reglamentos de la Administracion de Seguro Social requieren al Juez de la Ley Administrativa seguir un proceso de evaluacion, Si el Juez, determina en cualquier punto de este proceso que usted esta incapacitado o no incapacitado, no sera necesario continuar el proceso de acuerdo con el  proceso de evaluacion en secuencia el Juez toma en consideracion las siguientes precuntas;

1- Participa usted en trabajo substancial lucrativo?

2- Tiene usted un impedimento severo? (Un impedimento es severo si limita en forma significante sus habilidades fisicas o mentales para llevar a cabo actividades de trabajo basicas.)

3- Es su impedimento (o impedimentos) igual o equivalente a un punto de la lista en el apendice 1 de la subseccion P del Reglamento No.4?

4- Puede usted hacer cualquier otro tipo de trabajo que ha hecho en el pasado?

5- Puede usted hacer cualquier otro tipo de trabajo teniendo en cuenta su edad, educacion y previa experiencia de trabajo?
